Ketahuan Bercumbu Sesama Jenis, Dua Wanita Malaysia Dihukum Cambuk



Liputan6.com, Kuala Lumpur - Dua orang wanita dilaporkan mendapat hukum cambuk secara terbuka di Pengadilan Syariah Malaysia pada Senin 3 September 2018, karena diduga melakukan hubungan seks sesama jenis.

Hukuman tersebut mengundang kecaman internasional karena dinilai kejam, sekaligus menandakan kekhawatiran meningkat terhadap diskriminasi kelompok LGBT di Negeri Jiran.

Dikutip dari Time.com pada Selasa (4/9/2018), dua orang wanita yang diketahui berselisih usia 10 tahun itu ditangkap pada bulan April, setelah aparat penegak hukum Islam melihat mereka bercumbu di dalam sebuah mobil negara bagian Terengganu, menurut kantor berita Agence France-Presse.

Awal bulan ini, mereka mengaku bersalah atas tuduhan berhubungan seks sesama jenis, dan dijatuhi hukuman enam cambuk dan denda 3.300 ringgit (setara Rp 11,8 juta), dalam putusan hakim yang disebut "pelajaran bagi masyarakat".


Setelah penundaan selama seminggu karena kendala teknis, hukuman cambuk akhirnya dieksekusi pada Senin siang, di hadapan lebih dari 100 orang yang menyaksikan langsung di Pengadilan Tinggi Syariah, di ibu kota negara bagian.

"Hal yang menakutkan tentang tingginya diskriminasi yang dihadapi oleh orang-orang LGBT di Malaysia, dan sebuah hal yang sangat disayangkan bahwa pemerintah menyetujui eksekusi hukuman yang tidak manusiawi, dan juga merendahkan martabat," tulis Amnesty International dalam sebuah pernyataan.

Kelompok-kelompok lain mengutuk hukuman cambuk tersebut sebagai penyiksaan.

Kasus ini tidak hanya memicu kemarahan di antara organisasi-organisasi hak asasi manusia, tetapi juga menyoroti apa yang dikatakan aktivis sebaginya meningkatnya diskriminasi terhadap komunitas LGBT di Malaysia.

Bulan lalu, seorang wanita transgender dilaporkan dipukuli di sebuah negara bagian di selatan Semenanjung Malaysia.

Hanya seminggu sebelumnya, menteri urusan agama setempat memerintahkan penghapusan potret aktivis LGBT dari festival seni di Penang, mengatakan kepada wartawan, "Kami tidak mendukung promosi budaya LGBT di Malaysia."
 


Di Malaysia, pengadilan Islam menangani urusan agama dan keluarga dari penduduk muslim, yang merupakan mayoritas di negara tersebut.

Di seluruh 13 negara bagian dan wilayah federal, pengadilan Islam melarang hubungan seksual sesama jenis. Di Terengganu, di mana kedua wanita terkait dicambuk, liwat (sodomi) dan musahaqah (seks antar wanita) dapat dihukum hingga tiga tahun penjara, denda, dan maksimal enam pukulan cambuk. Namun, undang-undang tersebut sangat jarang diberlakukan.

Menurut Human Rights Watch, undang-undang anti-sodomi federal telah diterapkan hanya tujuh kali sejak 1938, dan empat di antaranya dituduhkan pada politisi oposisi Anwar Ibrahim, yang secara luas dilihat sebagai tuduhan palsu.

Para pegiat HAM mengatakan kepada kantor berita AFP bahwa hukuman cambuk pada hari Senin, adalah pertama kalinya bagi wanita yang melakukan hubungan sesama jenis.
